OWNERS WARRANT THAT THROUGHOUT THE DURATION OF THIS CHARTER PARTY THE VESSEL SHALL
REMAIN CAPABLE OF MAINTAINING, IN GOOD WEATHER CONDITIONS, A SPEED OF 13.8/13.5 KNOTS
AT A CONSUMPTION OF ABOUT 26.0 METRIC TONS / DAY OF FUEL OIL AND 0.1 METRIC TONS
OF DIESEL OIL / DAY. FOR THE PURPOSE OF THIS CLAUSE, "ABOUT" IS DEFINED AS 0.5 KNOTS
DOWNWARD ALLOWANCE FOR SPEED AND 5% UPWARD ALLOWANCE FOR CONSUMPTION. THE 5% UPWARD
ALLOWANCE NOT TO APPLY IF OWNERS CLAIMING CONSUMPTION SAVINGS AGAINST A SPEED CLAIM
BY CHARTERERS. FOR THE PURPOSE OF THIS CLAUSE, GOOD WEATHER IS DEFINED AS WINDS UP TO
AND INCLUDING BEAUFORT FORCE 4 AND/OR DSS 3 WITH SIGNIFICANT WAVE HEIGHT UP TO AND
INCLUDING 2 METERS. CHARTERERS SHALL SUPPLY WEATHER ROUTING SERVICES AND THE MASTER
SHALL COMPLY WITH THE REPORTING PROCEDURE OF THE WEATHER ROUTING SERVICE. OWNERS AND
CHARTERERS AGREE THAT THE EVIDENCE OF THE WEATHER, SEAS, AND CURRENTS SHALL BE TAKEN
FROM INDEPENDENT REPORTS BY THE WEATHER ROUTING SERVICE AND SHALL BE ACCEPTED AS
BINDING BY ALL PARTIES.
IN THE EVENT OF AN ALLEGED BREACH OF THE SPEED AND CONSUMPTION WARRANTY IN THIS
CHARTER PARTY, THE TIME LOSS AND BUNKER CONSUMPTION CAN BE DEDUCTED FROM HIRE AND
SHALL BE CALCULATED FOR EACH VOYAGE BY TAKING INTO ACCOUNT THE SHIP'S SPEED AND
CONSUMPTION CALCULATED ON THE BASIS OF GOOD WEATHER ANALYSIS WITH WIND, SEAS, AND
CURRENT FACTOR ANALYZED BY THE ROUTING SERVICE WHOSE FINDINGS SHALL BE DEEMED FINAL
AND BINDING.

when ballasting/ deballasting/ exchange of ballast operation and cargo holds' cleaning an additional consumption of about 2 MT IFO per day excluding BWTS.
Speed and consumption figures are warranted on good weather days which are defined as weather conditions up to and including Beaufort Force 4 or up to
